ENFORCEMENT

Lea County Environmental enforces Ordinance 83 Liquid Waste. Our officers will locate properties for liquid waste violations such as: unpermitted septic or holding tanks, illegal RV parks, RV's illegally connected to a septic tanks, right-of-way violations, set back violations, etc. All septic and holding tanks must be permitted from the state. Any new tanks will need pre-approval from the county in order to receive approval from the state.

Frequently Asked Questions

Can we install a septic system ourselves?
If there is already an existing system you will not be able to install a new system even if you are certified.

You are allowed to install one new residential septic system per year if certified by the state.

You are not allowed to install systems for commercial use. Contractors only.

Is my Cesspool grandfathered in?
No. All Cesspools are illegal and will have to get a legal septic system permitted by the state.

Can I irrigate with my gray water?
No, unless you are permitted by the state.

How do I get my septic system permitted?
If it is an existing structure you will need to submit a liquid waste application for pre approval for the State Environment Department.

Who do I use to pump out my RV's or holding tanks?
A Licensed Septic pumping company. Be sure to keep your receipts for up to five years.
