1. The Terms and Conditions will form part of the contract between the County and the successful bidder. Failure to comply with all of the Terms and Conditions may subject the offer to rejection.
2. All bids shall be sealed, addressed and delivered to: The Administrative Services Department, Courthouse, 100 North Main, Suite 11, Lovington, New Mexico 88260-4030. Please mark the outside of the envelope "BID #27". It is the bidder's responsibility to see that the bid arrives on time. Late bids, FAXes, telegrams or telephone bids will not be accepted.
3. Each bidder is to submit its bid on the form provided. The form must be fully completed.
4. All bids are FOB Lea County Courthouse, Lovington, New Mexico.
5. The bid shall exclude all State taxes. Nontaxable transaction certificates will be issued if requested.
6. Any resident business registered with the State Purchasing Agent may list its Resident Certification Number.
7. All bidders will be notified by letter of the Board's award.
8. Final inspection and acceptance will be made at the destination. Any products rejected at the destination for non-conformance with specifications shall be removed, at the Vendor's risk and expense, promptly after notice of rejection.
9. The Bidder agrees that the products furnished under this order shall be covered by the most favorable commercial warranties given to any customer. Bidder agrees not to disclaim warranties of fitness for a particular purpose or merchantability.
10. Bid specifications indicate the minimum standard of quality, performance or other pertinent characteristics required. All items equal or exceeding these specifications will be considered. All options, variations or exceptions to specifications must be listed.

11. All items are to be new and of most current production, unless otherwise specified as an exception.
12. The County reserves the right to waive technical irregularities in the form of the offer which do not alter price, quality or quantity, and to reject any or all offers when it is in the best interest of the County to do so.
13. In signing this bid, the Vendor certifies that there has been no direct or indirect action in restraint of free competitive bidding in connection with this bid submitted to Lea County.
14. The New Mexico Procurement Code, 13-1-28 through 199, NMSA, 1978, shall apply to this procurement and prevail over any inconsistent terms and govern all interpretations of contract documentation. In addition, criminal laws prohibit bribes, gratuities and kickbacks.
15. Other governmental entities are eligible to make purchases using this bid. Any other governmental entity purchasing products through this bid will be responsible for its own delivery and payment terms. Lea County assumes no obligations for any purchases other than its own.
16. The bidder will be required to carry:
a) General liability insurance in the amount of $1,000,000.00 per occurrence and $2,000,000.00 aggregate.
b) Auto liability insurance in the amount of $1,000,000.00 & $2,000,000.00 aggregate.
c) Workers’ Compensation insurance as required by New Mexico State Statute.
Lea County will be listed as an additional insured on all policies, and proof of coverage must be provided before work begins. Award will be contingent upon receipt of proof of insurance.
17. According to state procurement regulations, any protest of the award must be
submitted in writing within fifteen (15) days of written notice of award to:

Lea County is seeking bids to provide and install five (5) new shop bay doors & operators at the Road Department in Hobbs, NM.
Work Included:
The rolling doors shall be a series 625 or equal
Size of doors shall be 16 feet wide by 16 feet tall opening
The quantity shall be five (5) new doors and five (5) new operators
All 5 door/operator units to be exact duplicates of each other
Related Work:
Removal of old door and operator are to be included in price
Disposal and cleanup labor of old doors and related debris to be included in vendor price.
The new door guides on all 5 units will have to be inset 3” for clearance of existing electrical conduit to drum/hood spacing. Material consisting of 3”square tubing and 3”x2” angle iron to complete the project will be provided by the County and labor to install will be provided by the vendor. The existing guides are to be cut off the 5” channel iron opening structure, the square tubing and angle iron is to be stitch welded to the channel and the new guides are to be stitch welded to the square tubing
COUNTY RESPONSIBILITY
The County will provide an electrician to modify any existing service to meet the needs of the new operators as needed by the vendor
Field and finish painting will be the responsibility of the County
AFTER-HOURS SECURITY: County personnel will be responsible for after-hours security if removal and installation of door units require the premises to be insecure (vacated by County or door installer employment) outside scheduled business hours, 7:00 AM thru 5:00 PM Monday to Thursday, or County holiday schedules.

Quality Assurance:
Both the rolling doors and electric operators shall be manufactured by a single source producer of door systems
The doors will have a minimum wind load rating of 36 PSF
The new doors must equal or exceed the existing doors in moisture repellent abilities
The new doors must exceed the existing doors in wind and dust sealing abilities
Curtain:
Interlocking roll formed flat slats with minimum of 24 gauge metal interior and exterior
Malleable iron end locks and wind locks as needed to meet specified wind load rating
Slats are to be galvanized steel
Slat cavity to be filled with CFC-free, foamed in place, polyurethane insulation to provide a minimum R-value of 7.7
Quantity of 18, 5/8x3, 6 per row, 58” to 63 ½” from bottom of door panel fenestrations-lites for view and natural light per door
Bottom Bar:
The bottom bars shall be two primed-painted steel angles, minimum thickness of 1/8”, bolted back to back, and shall have a bottom water seal
The bottom seal assemblies must prevent water from entering building by seepage under doors
Guides:
Guides shall be three structural steel angles with a minimum thickness of 3/16”
Guides shall be weather-stripped with a vinyl weather seal at each jam on the exterior curtain side and shall be furnished with wind lock bars
Brackets:
Brackets shall be hot-rolled steel plates
Counterbalance:
The counterbalances shall be adjustable, helical torsion springs designed for a minimum of 50,000 cycles, housed in a steel tube or pipe barrel, support the curtain with a deflection limited to .03” per foot of span, and shall be adjustable by means of an adjusting tension wheel

Hood:
The hoods shall be a minimum of 24 gauge, galvanize steel, and shall be supplied with an internal hood baffle weather seal and an external lintel weather seal
Operation:
Operation shall be gear reduced without v-belt(s)
Motors shall be 1 Hp minimum for use on 460/3/60 electric power
Control circuits shall be a 3 button control station (open-close-stop)
Operators to be furnished with an emergency chain hoist
Bench mount type door drives by chain and sprockets
Speed reduction by gear reduction (belt reduction not acceptable)
Safety:
The doors shall be equipped with a pneumatic safety edge with a take up reel
Execution:
The rolling service doors and related components shall be installed in accordance with manufacture instructions and standards
Installation will be by an authorized vendor that represents the manufacture of the units
Warranty:
Supply all warranty information granted by manufacture, plus all variables of installer to service doors under warranty conditions. Variables included all costs to the County by vendor installing door to meet warranty requirements

OPTIONAL WORK / PRICING
OPTIONAL WORK WHILE THE AWARDED CONTRACTOR IS ALREADY ON SITE – Lea County will consider cost for Contractor to furnish existing (on-site) equipment and labor to install two (2) used coiling doors and operators furnished by County.
Remove two existing 16’x16’ coiling doors and operators in wash bay area
Utilize and adjust existing wash bay guides; guides in wash bay has a 1 3/8” spacing / is adjustable and removed used door guides have a 1 ½” spacing/is adjustable
Electrical conduit does not inhibit drum/hood space to require inset work
Labor and material costs beyond this realm would be cost plus
Disposal and clean-up, County supplied electrician, requirement to secure premises, and finish painting by County, will still apply in price structure for this optional work.
This additional project may or may not be awarded, depending on budget constraints.
